1. Do I need to file US taxes if I live in Spain?
Yes, all US citizens and green card holders must file US tax returns annually, regardless of where they live. Filing a US tax return from Spain is mandatory even if you pay Spanish taxes. The US taxes based on citizenship, not residence, so your Spanish income must be reported to the IRS.
2. How does Beckham Law affect my US taxes?
Beckham Law (Special Expat Tax Regime) allows qualifying expats in Spain to pay a flat 24% tax on Spanish-source income for up to 6 years. For US taxes, you still report worldwide income but can claim Foreign Tax Credits for Spanish taxes paid under the Beckham Law. This often results in low or zero US tax liability due to the credits.
3. Can I use the Foreign Tax Credit for my Spanish taxes?
Yes, with Spanish tax rates reaching 47%, the Foreign Tax Credit (Form 1116) is usually the best strategy for Americans in Spain. You can claim credits for Spanish taxes paid, which typically eliminates or significantly reduces your US tax liability. Even under Beckham Law's lower rates, FTC remains valuable.
4. Do I need to report my Spanish bank accounts to the IRS?
Yes, if your Spanish bank accounts (Santander, BBVA, CaixaBank, Sabadell, etc.) exceed $10,000 USD at any time during the year, you must file FBAR (FinCEN Form 114) by April 15. You may also need FATCA Form 8938 if accounts exceed $200,000 for single filers.
5. What are my US tax filing deadlines from Spain?
US expats in Spain receive an automatic extension to June 15 for IRS filing. You can request a further extension to October 15. Any US taxes owed must be paid by April 15 to avoid IRS interest charges. Since Spain uses the calendar year like the US, income allocation is straightforward.
6. Do I report Spanish wealth tax and Modelo 720 to the IRS?
The Spanish wealth tax (Impuesto sobre el Patrimonio) is deductible on your US return as a foreign tax. Modelo 720 (Spanish foreign asset declaration) is separate from US reporting - you must file both FBAR with the IRS and Modelo 720 with Spain. These are independent requirements with different thresholds and deadlines.
7. Should I use FEIE or Foreign Tax Credit in Spain?
For most Americans in Spain, the Foreign Tax Credit is better than FEIE due to Spanish tax rates (19-47% progressive, plus regional surcharges). FTC preserves IRA contribution eligibility and typically provides full US tax relief. Under Beckham Law's flat 24% rate, FTC still works well. FEIE might benefit lower earners not under the Beckham Law.
8. What if I haven't filed US taxes in years while living in Spain?
You may qualify for IRS Streamlined Filing Compliance Procedures, allowing you to catch up on 3 years of US tax returns and 6 years of FBARs with reduced penalties, provided non-compliance was non-willful. Many Spain expats didn't realize that a US filing was required despite paying Spanish taxes.
9. How does autonomo status affect my US taxes?
If you're self-employed (autonomo) in Spain, you must report this income on Schedule C of your US return and typically pay US self-employment tax (15.3%) even while paying Spanish autonomo social security. Foreign Tax Credits can offset some US liability. The US-Spain totalization agreement may provide relief in certain situations.
10. Can I contribute to a US IRA while living in Spain?
Yes, if you have qualifying earned income and use the Foreign Tax Credit strategy (not FEIE). Since the FTC is optimal for Spain's tax environment, most expats can maintain IRA eligibility. You can contribute up to $7,000 ($8,000 if 50+) for 2025, assuming sufficient earned income.
11. How does the US-Spain tax treaty affect my taxes?
The US-Spain tax treaty prevents double taxation and provides guidance on which country has primary taxing rights for different income types. It's particularly important for pensions, dividends, and social security. The treaty includes a saving clause provision, meaning the US still taxes its citizens on worldwide income but allows Foreign Tax Credits.
12. When should I hire a US tax advisor in Spain?
Consider hiring an American tax service if you have Spanish bank accounts over $10,000, qualify for Beckham Law, earn over $100,000, are self-employed (autonomo), must file Modelo 720, need Foreign Tax Credit optimization, or haven't filed US taxes in years. Spain's unique tax features, like the Beckham Law, require specialized US expat tax expertise.
