1. Do I need to file US taxes if I live in Thailand?
Yes. US citizens and many Green Card holders living in Thailand remain subject to US tax rules on worldwide income and generally must file regardless of where they live, including Thailand. Your worldwide income is reportable to the IRS, though credits and exclusions like the Foreign Tax Credit and Foreign Earned Income Exclusion often reduce or eliminate what you owe.
2. How does Thailand's 180-day residency and remittance rule affect my US taxes?
Under Thailand’s current interpretation, certain foreign-sourced income earned from January 1, 2024 while the individual was a Thai tax resident may become taxable when remitted to Thailand. Transfers of pre-2024 income or non-income capital may be treated differently.
3. Do I need to report my Thai bank accounts to the IRS?
Yes, if the combined value of your foreign accounts – including those at Bangkok Bank, Kasikorn, SCB, or other Thai institutions – exceeds $10,000 at any time during the year. We prepare your FinCEN Form 114 (FBAR) and Form 8938 (FATCA) as applicable.
4. Is there a US-Thailand totalization agreement?
No. The US and Thailand do not have a totalization agreement. Depending on whether you are an employee, who employs you, and whether you are self-employed, you may face overlapping US and Thai social security obligations.
5. What if I haven't filed US taxes in years while living in Thailand?
The Streamlined Foreign Offshore Procedures may allow eligible taxpayers to catch up and receive relief from specified failure-to-file, failure-to-pay, accuracy-related, information-return, and FBAR penalties. Any tax and statutory interest remain due.
6. How is crypto and investment income taxed if I live in Thailand?
Crypto transactions and investment income remain reportable on your US return regardless of where you live. Thai-domiciled mutual funds and pooled investments may also be classified as PFICs, which carry their own reporting requirements (Form 8621).
7. What are my US tax filing deadlines from Thailand?
US citizens abroad, including those in Thailand, get an automatic two-month filing extension to June 15, with a further extension available to October 15 by filing Form 4868. Interest applies to any unpaid tax after April 15, even with an extension to file.
8. Can I use the Foreign Tax Credit or FEIE for Thai income?
Yes. Most Americans in Thailand can use the Foreign Earned Income Exclusion, the Foreign Tax Credit, or a combination of both to reduce US tax on Thai-sourced income, depending on your income type and Thai tax paid.
9. How does the US-Thailand tax treaty affect my taxes?
The US and Thailand have a tax treaty that addresses certain types of income and helps prevent double taxation in specific situations, though it does not replace your obligation to file a US return. We review treaty provisions relevant to your situation as part of your filing.
