1. Do I need to file US taxes if I live in Mexico?
Yes, all US citizens and green card holders must file US tax returns annually, regardless of where they live. Filing taxes for expats in Mexico is mandatory even if you pay Mexican taxes. The US taxes based on citizenship, so your Mexican income must be reported to the IRS.
2. Can I exclude my Mexican income using FEIE?
Yes, most Americans in Mexico can exclude up to $130,000 (2025 amount) using the Foreign Earned Income Exclusion (FEIE) on Form 2555. Since Mexican tax rates are relatively moderate (up to 35%), FEIE is often more beneficial than the Foreign Tax Credit. You must meet either the Physical Presence Test (330 days outside the US) or the Bona Fide Residence Test.
3. Do I need to report my Mexican bank accounts to the IRS?
Yes, if your Mexican bank accounts (Banamex, BBVA México, Santander México, Banorte, etc.) exceed $10,000 USD at any time during the year, you must file FBAR (FinCEN Form 114) by April 15. You may also need FATCA Form 8938 if accounts exceed $200,000 for single filers.
4. What are my US tax filing deadlines from Mexico?
US expats in Mexico receive an automatic extension to June 15 for IRS filing. You can request a further extension to October 15. Any US taxes owed must be paid by April 15 to avoid IRS interest charges. Since Mexico uses the calendar year like the US, income allocation is straightforward.
5. Should I use FEIE or Foreign Tax Credit in Mexico?
For most Americans in Mexico, FEIE is better than the Foreign Tax Credit. With Mexican tax rates of 1.92-35% (progressive), FEIE's flat $130,000 exclusion typically provides greater benefit, especially for middle-income earners. FEIE also simplifies filing. FTC might work better for very high earners above the FEIE threshold.
6. How do I report Mexican rental income to the IRS?
Report Mexican rental income on Schedule E of your US tax return. You can claim Foreign Tax Credits for Mexican taxes paid on rental income. Mexican peso rental income must be converted to US dollars using IRS-approved exchange rates. Expenses must be properly documented and allocated.
7. What if I haven't filed US taxes in years while living in Mexico?
You may qualify for IRS Streamlined Filing Compliance Procedures, allowing you to catch up on 3 years of US tax returns and 6 years of FBARs with reduced penalties, provided non-compliance was non-willful. Many Mexican expats, especially retirees and digital nomads, didn't realize that US filing remained mandatory.
8. How does retirement in Mexico affect my US taxes?
US Social Security benefits are taxable on your US return regardless of where you live. If you have Mexican source income (rental, investments), you report it and may use FEIE or FTC. Retirees in Mexico often have simpler returns but must still file annually if they meet income thresholds.
9. Can I contribute to a US IRA while living in Mexico?
Yes, if you have qualifying earned income. If using FEIE, excluded income cannot fund IRAs, which may limit contributions. If you claim the full $130,000 exclusion, you cannot contribute to IRAs that year. Consider claiming less FEIE if maintaining IRA contributions is important for retirement planning.
10. How does the Physical Presence Test work for Mexican expats?
If you're physically present outside the US for 330 full days during any 12-month period, you qualify for FEIE. Most Mexican expats easily meet this test. Careful tracking of US visits is essential - even short trips count. Each day counts as "present" where you are at midnight.
11. Do I pay US Social Security tax on Mexican income?
It depends. If employed by a US company, you typically pay Social Security and Medicare taxes (15.3% total). If employed by a Mexican company, you generally don't pay these taxes. Self-employed individuals must pay self-employment tax on net earnings, though FEIE reduces the income subject to this tax.
12. When should I hire an expat tax consultant for Mexico?
Consider hiring expat tax advisors if you have Mexican bank accounts over $10,000, earn over $100,000, own Mexican rental property, work as a digital nomad or freelancer, are retired with multiple income sources, need FEIE optimization, or haven't filed US taxes in years. Mexican lower tax rates make the FEIE strategy critical for maximizing benefits.
